Introduction to Muqaddamah Bahawalpur 1935

By Muhammad Ismail Quraishi
Senior Advocate Supreme Court of Pakistan
Chairman, World Association of Muslim Jurists

muqaddima_bahawalpur

I feel myself deeply privileged to write introduction to this historic Judgment pronounced by a Learned Special Judge, Muhammad Akbar Khan. He was required by the Judicial Council, the highest Tribunal in Judicial Hierarchy of the Muslim State of Bahawalpur to reconsider the Judgment of the Chief Court of Bahawalpur, which had held Qadianis to be a sect of Islam. It was the most controversial issue whether a marriage of a Muslim woman subsists with a husband after his conversion from Islam to Qadiani faith. This was a case of chequered history witnessing divergent decisions.

Following the Imams, The Importance of Taqleed and the Consensus of the Ummah upon the Compulsion of Following the Four Imams

By Mufti Abdur Raheem Lajpuri رحمة اللہ علیه

taqleed_ilmQuestion: 1) What do the ‘Ulema of Deen and the Muftis say about a man in our city of Baruch who has adopted the ways of the Ahl e Hadith. He raises his hands during every Raka’ah of Salah and says Ameen loudly. Our Hanafi brothers say that these are acts of Bid’ah. Is raising the hands and saying Ameen loudly acts of the Sunnah or acts of Bid’ah? Please explain with references.
2) This brother says that raising the hands is a Sunnah of Rasulullah ﷺ and the Khulafaa Raashideen and that the Hanafi book Hidayah (Vol.1 pg 379) proves that Rasulullah ﷺ did it until the end of his life. He also says that saying Ameen loudly is also proven in Hidayah (Vol.1 pg 362) and that both raising the hands and saying Ameen loudly are acts of the Sunnah. Is raising the hands and saying Ameen loudly acts of the Sunnah or acts of Bid’ah? Please explain with references.

More Women in Hell than Men and Their Deficiency in Religion and Intelligence

By Ebrahim Saifuddin

It is related that Abu Sa'id al-Khudri رضي الله عنه said, "The Messenger of Allah ﷺ, set out to the place of prayer on the Day of Adha or Fitr and passed by the women. He said, 'O congregation of women! Give alms for I have seen that you will make up the majority of the inhabitants of the Fire!' They said, 'Why, Messenger of Allah?' He said, 'You call down too many curses and show ingratitude to your husbands. I have not seen anyone more deficient in intellect or deen. Yet the mind of even a resolute man might be swept away by one of you.' They said, 'In what way is our deen and intellect deficient, Messenger of Allah?' He said, 'Is not the testimony of a woman worth only half that of a man?' They said, 'Yes.' He said, 'That is how your intellect is deficient. Is it not so that when a woman is menstruating, she neither prays nor fasts?' They said, 'Yes.' He said, 'That is how her deen is deficient.'" – (Bukhari; Book of Menstruation, Chapter of Menstruating Women Abstaining from Fast)
